Judge Facemire Sentences Hinerman to 1-5 years in prison

Several Braxton County Circuit Court hearings have recently been completed by the Honorable Judge Richard A. Facemire.
In February Cody Earl Hinerman came before the court with his attorney Timothy Rosinsky for a plea hearing. Assistant PA Acord represented the state and Jacob Foster was present on behalf of the probation office. Hinerman entered a no contest plea to the felony count of aiding escape and other offense relating to adults in custody or confinement. The state agreed to stand silent at sentencing and have the other charges dismissed. The defense requested the court proceed directly with sentencing. Judge Facemire sentenced Hinerman to one to five years in the state penitentiary with the sentence set to run consecutively with any he is currently serving.
On March 7, Robert Ray Jones appeared in court with his attorney Bernard Mauser for a plea hearing. The state was represented by Assistant Prosecuting Attorney Dara A. Acord, Jacob Foster of the Braxton County Probation Office was also present during the proceedings. The defendant entered a guilty plea to the felony charges of possession of heroin with intent to deliver and conspiracy. The state agreed to dismiss remaining charges and stand silent at the sentencing hearing. The sentencing hearing has been set for May 8.
On March 2, Michael Kevin Tanner came before Judge Facemire for a plea hearing. He was represented by Kevin Hughart. Braxton County Prosecuting Attorney Jasmine R.H. Morton represented the state. Tyler Morlan from the probation officer was also present. Tanner entered a guilty plea to the felony offense of possession of methamphetamine with intent to deliver and the state will stay silent at the sentencing hearing. His sentencing hearing is scheduled for May 8.
On February 21, Justin Nichiniello failed to appear for arraignment. His attorney Kevin Hughart was present and was unsure of his client’s whereabouts. Judge Facemire ordered a warrant for his immediate arrest and his bond revoked. The bond will set at $100,000 cash only pending further court proceedings. BCPA Morton represented the state during the hearing.
On February 7, Ernest Samuel Weaver, II and his attorney Jonatha Fittro appeared before the court for a plea hearing. Jacob Foster was also present from the probation office and Assistant PA Acord represented the state. A plea agreement had been reached between both parties. The defendant agreed to enter a guilty plea to the possession of methamphetamine with intent to deliver. The state agreed to recommend alternative sentencing and dismiss other charges. His sentencing hearing has been set for April 10.
